Terms and conditions of use — Olutax

These terms govern the use of the mobile app “Olutax” for iOS and Android (identifier com.opharana.olutax) and of the pages of this website that open from its links (together, “Olutax”), whose owner is OPHARANA LLC, located at 99 Wall Street, Suite 1432, 10005, New York, United States, email hello@opharana.com.

By downloading, installing or using Olutax you accept these terms. If you do not agree with them, do not use it.

1. What Olutax is

Olutax is a notebook for keeping a group's fine pot (a team, a crew, a flat, an office). It lets you create groups with a list of fines, log fines against people, whether or not they have the app, mark what is paid, see the pot, a goal and the rankings. The members of a group share their data.

Olutax is not a payment or collection service. Money is paid outside the app, in cash or by whatever means the group uses. The app only records what each person says they owe and have paid; it does not verify or guarantee payments and does not mediate disputes. Nor is it a betting or raffle platform. Fines are a game between people who have agreed to it: they are not penalties, enforceable debts or claims, and nobody is obliged to pay them for using Olutax.

2. Minimum age

Olutax is intended for people over 14. By using it you declare that you are at least that age.

3. Your account

When you open the app, an anonymous account tied to that installation is created. If you delete it or change phones without having linked it to Apple, Google or an email, you lose access to that account and we cannot recover it. You can rejoin your groups with their code. You can delete your data at any time from Settings → “Delete my data” (details in the Privacy Policy).

4. Groups, content and conduct

The members of a group see its name, its people, its fines and its payments. Share a group's link or code only with whoever you want to join: with it, anyone can join.

You are responsible for what you write: the names of groups, people and fines, and the notes. If you add someone who does not use the app, enter only a name or nickname that the person agrees to. Fines are jokes. By using Olutax you agree not to:

• Write content that is offensive, humiliating, discriminatory, unlawful or that harasses anyone, or third parties' personal data without their permission.
• Impersonate another person or join groups you have not been invited to.
• Modify the app, reverse engineer it or attempt to access other users' data.
• Create accounts, groups or fines in bulk or to obtain rewards fraudulently.
• Use Olutax to collect real debts, to extort or for unlawful purposes.

You can report any content from the app or at hello@opharana.com. The treasurer can void their group's fines, and we may delete content, groups and accounts that breach these terms.

5. Free and Olutax Plus

Without paying, Olutax gives you up to two groups, the templates, the history and the rankings, with ads. Olutax Plus removes the ads and adds unlimited groups. Plus is personal: it applies to the store account of whoever buys it. It is offered with the price in your currency shown before you buy:

• Monthly subscription with automatic renewal. The amount is charged to your Apple or Google account when you confirm the purchase and, afterward, at the start of each period, unless you cancel at least 24 hours before the current period ends.
• One-time payment, forever (Plus). You pay once, it does not renew and it keeps Plus on your store account for as long as Olutax remains available.

How to cancel: on iPhone, Settings → your name → Subscriptions → Olutax → Cancel subscription; on Android, Google Play → your profile picture → Payments & subscriptions → Subscriptions → Olutax → Cancel subscription. When you cancel you keep what you bought until the end of the paid period. Uninstalling the app or deleting your data does not cancel the subscription.

• Payment is processed entirely by Apple or Google, under their terms. We do not see or store your card details.
• Digital content is delivered immediately after purchase. By accepting immediate delivery you may lose the right of withdrawal that applies to digital content.
• Refunds and payment claims are handled through Apple or Google. The purchase is recovered with “Restore purchases”, using the same store account.
• We may change prices. If the price of a subscription changes, Apple or Google will notify you before applying it and you will be able to cancel.

6. One month of Plus for inviting

If someone joins your group with your invitation and receives or issues their first fine, each of you earns one month (30 days) of Olutax Plus, up to a maximum of 12 months per person. Each person can only earn once for using an invitation, and your own does not count. The months add to any you already have, are checked by our server, have no monetary value, cannot be exchanged for money and do not affect a paid subscription. We may change or end this promotion, without affecting months already earned, and cancel rewards obtained fraudulently. We never reward store ratings.

7. Advertising

The app shows Google AdMob ads and, with the app in Spanish, ads from TuIAgencia. An ad is never shown when you log a fine. In the European Economic Area, the United Kingdom and Switzerland you are asked for consent before any Google ad loads. With Plus no advertising is shown. Details are in the Privacy Policy.

8. Service availability

Olutax needs internet to create groups, join them and share fines with their members. It depends on third-party services and we do not guarantee that it will work without interruptions or errors. We may modify, update or withdraw features and, if necessary, discontinue Olutax; if it were a permanent shutdown, we would announce it with reasonable notice.

9. Intellectual property and license of use

Olutax, its code, its texts, its design and its graphic elements are owned by OPHARANA LLC or by third parties who have authorized their use. We grant you a personal, limited, non-exclusive, revocable and non-transferable license to use Olutax for private, non-commercial purposes. The brand uses the typefaces Schibsted Grotesk and JetBrains Mono, licensed under the SIL Open Font License 1.1. The app also includes third-party software under its open-source licenses.

10. Limitation of liability

Olutax is provided “as is”. To the maximum extent permitted by law, the owner is not liable for indirect damages, loss of profit, loss of data, disputes between group members about what is owed or paid, app errors, or what other users write. Nothing in these terms excludes liability that cannot be excluded by law or the rights that consumer legislation grants to consumers.

11. Relationship with Apple and Google

These terms are between you and OPHARANA LLC, not with Apple or Google, which assume no responsibility for the app, its content, its maintenance or its support. On iOS, Apple and its subsidiaries are third-party beneficiaries of these terms.

12. Changes, governing law and language

We may update these terms; the current version is the one published on this page with its date, and if the change is substantial we will notify you in the app. These terms are governed by Spanish law. If you act as a consumer, you keep the right to go to the courts of your place of residence. They are published in several languages; in case of discrepancy, the Spanish version prevails.
